ESTE CONTRATO DE LICENÇA DE USUÁRIO FINAL ("EULA") AJUSTA OS TERMOS E CONDIÇÕES EM QUE NÓS, WEBZEN DUBLIN LIMITED, UMA CORPORAÇÃO IRLANDESA E SEUS LICENCIANTES (COLECTIVAMENTE, "WEBZEN", "NÓS", "NOSSO") PERMITIMOS QUE VOCÊ DESCARREGUE E INSTALE SOFTWARE E DOCUMENTAÇÕES ONLINE RELACIONADAS OU ELETRÔNICAS (COLETIVAMENTE, O "SOFTWARE DE JOGO") VOCÊ PRECISARÁ JOGAR CERTOS JOGOS DE COMPUTADORES ("JOGOS") EM CONJUNÇÃO COM AS CARACTERÍSTICAS E FUNCIONALIDADE OFERECIDAS POR NOSSO SERVIÇO DE JOGO ON-LINE O ("SERVIÇO") NO WEBSITE WEBZEN EM WWW.WEBZEN.COM (O "WEBSITE").
AO CLICAR NO BOTÃO "ACEITAR" ABAIXO OU UTILIZAR O JOGO OU INSTALAR O SOFTWARE DO CLIENTE DE JOGO, VOCÊ CONCORDA LEGALMENTE A CADA UM DOS TERMOS E CONDIÇÕES DESTE EULA. SE VOCÊ NÃO DESEJA SER LEGALMENTE LIMITADO PELOS TERMOS E CONDIÇÕES DESTE EULA, VOCÊ DEVE CLICAR NO BOTÃO "CANCELAR" E NÃO TERMINAR A INSTALAÇÃO DO SOFTWARE.
1. Concessão de uma Licença Limitada.
Sujeito ao seu acordo e ao cumprimento contínuo dos termos e condições deste EULA e dos Termos de Serviço e Política de Privacidade publicados no site (que são incorporados por meio desta referência), a WEBZEN concede a você uma licença limitada, não exclusiva, Não transferível e revogável para: (a) baixar e instalar o Software do Jogo em seu computador pessoal, e (b) usar o Software do Jogo em conjunto com o Serviço no Website exclusivamente para fins de entretenimento não comercial.
2. Propriedade.

3. Limitações Específicas.
As licenças concedidas a você por este EULA são pessoais para você e estão sujeitas às seguintes limitações adicionais. Você não deve permitir ou permitir que qualquer outra pessoa:
(A) no todo ou em parte, (i) modificar ou criar qualquer trabalho derivado do Software do Jogo, ou (ii) copiar, fotocopiar, reproduzir, traduzir, desmontar, fazer engenharia reversa, descompilar ou tentar extrair o código fonte, Ideias subjacentes, algoritmos, estrutura ou organização do Software de Jogo;
(B) modificar ou remover quaisquer direitos autorais, patentes, confidencialidade e outros avisos, rótulos ou legendas no Software do Jogo;
(C) vender, conceder uma garantia mobiliária ou transferir reproduções do Jogo ou Software de Jogo para outras partes, de qualquer forma não expressamente autorizada neste documento;
(D) atribuir, alugar, arrendar ou licenciar o Jogo ou Software de Jogo a terceiros;
(E) explorar o Jogo ou Software de Jogo ou qualquer de suas partes para qualquer propósito comercial, incluindo, mas não se limitando a, uso em uma lan house, centro de jogos de computador ou qualquer outro local baseado em local sem o consentimento expresso por escrito da WEBZEN;
(F) hospedar, fornecer ou desenvolver serviços de matchmaking para o Game ou interceptar, emular ou redirecionar os protocolos de comunicação usados pela WEBZEN ou seus licenciadores de qualquer forma, incluindo, sem limitação, através da emulação de protocolos, tunelamento, sniffer de pacotes, modificação ou adição de componentes Para o jogo, uso de um programa de utilidade ou qualquer outra técnica agora conhecida ou desenvolvida para qualquer finalidade, incluindo, mas não limitado a, jogo de rede não autorizado através da Internet, jogo de rede utilizando redes de jogos comerciais ou não comerciais ou como parte Redes de agregação de conteúdos;

(H) criar ou manter, sob quaisquer circunstâncias, quaisquer ligações não autorizadas ao Jogo ou ao Serviço. Todas as ligações ao Jogo e / ou ao Serviço só podem ser feitas através de métodos e meios expressamente aprovados pela WEBZEN. O não cumprimento das restrições e limitações listadas acima e noutras partes deste EULA resultará na rescisão imediata e automática da licença concedida nos termos deste documento e poderá sujeitá-lo a responsabilidade civil e / ou criminal. Não obstante o acima exposto, você pode fazer uma (1) cópia do Software do Jogo apenas para fins de arquivo.
4. Font Software.
The Game Software contains, as a component, third party software, including Font Software that is proprietary to the licensor or its suppliers and subject to the copyright laws of the United States and other jurisdictions.
The Font Software may not be altered, modified or extracted from the Game Software.
Your use is limited to “Internal Use” meaning use of the Font Software only in the course of your customary and ordinary personal use and not for further resale, sublicensing or distribution. “Customary and ordinary personal use” shall mean use by you for internal personal purposes.
5. Termination.
This EULA is effective until terminated. You may terminate the EULA at any time by (a) removing the Game Software from your personal computer hard drive; and (b) notifying WEBZEN of your intention to terminate this EULA. WEBZEN and/or is licensors may, at their sole discretion, terminate this EULA in the event that you fail to comply with the terms and conditions contained herein, or the terms and conditions contained in the Terms of Service or Privacy Policy. In such event, you must immediately destroy and remove the Game Software from your personal computer hard drive. Upon termination of this EULA for any reason, all licenses granted herein shall immediately terminate.
6. Modifications to Game Software.
WEBZEN and/or its licensors may deploy or provide patches, updates, error corrections, bug-fixes, and modifications to the Game Software that must be installed for the user to continue to play the Game. WEBZEN and/or its licensors may update the Game Software remotely, including, without limitation, the Game Software residing on the user’s machine, without your knowledge or consent, and you hereby grant to WEBZEN and its licensors your consent to deploy and apply such patches, updates, error corrections, bug-fixes, and modifications to the Game Software.
7. Termination or Discontinuation of Service.
The Game is an “on-line” computer game that must be played over the Internet through the Service, as provided by WEBZEN. You understand and agree that the Service is provided by WEBZEN at its discretion and may be terminated or otherwise discontinued by WEBZEN pursuant to the Terms of Service.
8. Limited Warranty.
WEBZEN AND ITS LICENSORS EXPRESSLY DISCLAIM ANY WARRANTY FOR THE GAME OR THE GAME SOFTWARE AND ANY COMPONENTS THERETO. THE GAME AND GAME SOFTWARE ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF CONDITION, DEFECTS, USE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, OR NONINFRINGEMENT. YOU ASSUME THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE GAME AND GAME SOFTWARE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
9. Limitation of Liability.
NEITHER WEBZEN NOR ITS PARENT, SUBSIDIARIES OR AFFILIATES, OR ITS LICENSORS SHALL BE LIABLE IN ANY WAY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF THE GAME OR GAME SOFTWARE, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER DAMAGES OR LOSSES. ANY WARRANTY AGAINST INFRINGEMENT THAT MAY BE PROVIDED IN SECTION 2-312(3) OF THE UNIFORM COMMERCIAL CODE AND/OR IN ANY OTHER COMPARABLE STATE STATUTE IS EXPRESSLY DISCLAIMED. FURTHER, WEBZEN AND ITS LICENSORS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY IN ANY WAY FOR THE LOSS OR DAMAGE TO PLAYER CHARACTERS, ACCOUNTS, STATISTICS OR USER PROFILE INFORMATION STORED BY THE GAME AND/OR THE SERVICE. WEBZEN AND ITS LICENSORS SHALL NOT BE RESPONSIBLE FOR ANY INTERRUPTIONS OF SERVICE, INCLUDING, BUT NOT LIMITED TO, ISP DISRUPTIONS, SOFTWARE OR HARDWARE FAILURES OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE. IN NO EVENT WILL WEBZEN OR ITS LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
10. Equitable Remedies.
You hereby agree that WEBZEN and its licensors would be irreparably damaged if the terms of this EULA were not specifically enforced, and therefore you agree that WEBZEN and its licensors shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of this EULA, in addition to such other remedies as WEBZEN and its licensors may otherwise have available to it under applicable laws. You hereby agree to indemnify and hold WEBZEN and its licensors harmless from and against any liabilities, damages, judgments, losses, costs and expenses (including reasonable attorneys’ fees) arising out of your download, installation and use of the Game Software, and use of the Service, in a manner inconsistent with the terms and conditions of this EULA, the Terms of Service or the Privacy Policy. In the event any litigation is brought by WEBZEN or its licensors in connection with this EULA and either is deemed a prevailing party, each shall be entitled to recover from you all the costs, attorneys’ fees and other expenses it incurred in such litigation.
11. EULA Amendments.
WEBZEN and its licensors reserve the right, at their sole discretion, to amend, add or delete any of the terms and conditions of this EULA when the Game Software is upgraded, effective upon prior notice as follows: WEBZEN will post notification of any such changes to this EULA on the Website and will provide a link to the revised version of this EULA, and may provide such other notice as WEBZEN may elect in its sole discretion. If any future changes to this EULA are unacceptable to you or cause you to no longer be in compliance with this EULA, you may terminate this EULA in accordance with the terms herein. Your installation and use of any updated or modified Game Software or your continued use of the Game Software following notice of changes to this EULA as described above means you accept any and all such changes. WEBZEN and its licensors may change, modify, suspend, or discontinue any aspect of the Game, Game Software and/or the Service at any time. WEBZEN may also impose limits on certain features or restrict your access to parts or all of the Game without notice or liability. You disclaim any right, title or interest, monetary or otherwise, in any feature or content contained in the Game, Game Software and/or the Service.
12. Miscellaneous.
This EULA shall be deemed to have been made and executed in Korea without regard to conflicts of law provisions, and any dispute arising hereunder shall be resolved in accordance with the laws of Korea. You agree that any claim asserted in any legal proceeding by one of the parties against the other shall be commenced and maintained in any state or federal court located in Korea, Seoul, having subject matter jurisdiction with respect to the dispute between the parties. In the event that any provision of this EULA shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining portions of this EULA shall remain in full force and effect. This EULA constitutes and contains the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior oral or written agreements, provided, however, that this EULA shall coexist with, and shall not supersede, the Terms of Service or the Privacy Policy. To the extent that the provisions of this EULA conflict with the provisions of the Terms of Service or the Privacy Policy, the conflicting provisions in the Terms of Service or the Privacy Policy shall govern. I hereby acknowledge that I have read and understand the foregoing EULA and agree that the action of downloading and installing the Game Software is an acknowledgment of my agreement to be bound by the terms and conditions of the EULA contained herein.
